Welcome to The Birdie Bar. These Terms & Conditions ("Terms", "Agreement") govern your access to and use of our website, facility, golf simulator equipment, online services, event booking platforms, and electronic agreement systems (collectively, the "Services").

By accessing our website, booking a simulator bay, submitting an event proposal, or executing an agreement through our online system, you agree to be bound by these Terms. If you do not agree, please do not use our Services.

1. Ownership & Service Description

The Services are owned and operated by The Birdie Bar ("Company," "we," "us," or "our"). We operate a venue offering food, beverage, retail, golf simulator bay rentals, and private event space, along with web applications (including Birdie Bar Event Live and Birdie Bar Proposal System) used to facilitate event quotes, proposals, contracts, and electronic signatures.

2. Electronic Signatures & ESIGN Consent

When using our web platforms to review, approve, or execute event proposals, contracts, or waivers:

  • Consent to Electronic Transactions: You agree to conduct transactions, receive notices, and execute contracts electronically pursuant to the Electronic Signatures in Global and National Commerce Act (ESIGN Act) and the Uniform Electronic Transactions Act (UETA).

  • Binding Legal Effect: Electronic signatures submitted through our systems carry the same legal weight and enforceability as handwritten physical signatures.

  • Third-Party Processing via DocuSign: Electronic contract creation, envelope management, and signature processing are powered by DocuSign, Inc. By submitting an electronic signature through our platforms, you agree to be bound by DocuSign’s standard signing terms and policies in addition to this Agreement.

3. User Responsibilities & Account Security

When interacting with our Services or submitting information, you agree to:

  • Provide accurate, current, and complete information regarding your identity, contact details, billing information, and authorized signers.

  • Maintain authority to legally bind any business, organization, or entity on whose behalf you execute an agreement or make a booking.

  • Refrain from using the website or booking platforms for fraudulent, unauthorized, or unlawful purposes.

4. Venue, Golf Simulator & Event Rules

  • Safety & Equipment Use: Guests using our golf simulators must follow all posted operating guidelines, staff instructions, and safety protocols. You are responsible for any intentional damage or misuse of simulator hardware, hit screens, tracking sensors, or property.

  • Alcohol & Conduct: Food and beverage services are subject to local liquor licensing laws. The Birdie Bar reserves the right to refuse service or remove any guest demonstrating disorderly conduct or intoxication without refund.

  • Event Deposits & Cancellations: Bookings and private event proposals are subject to specific payment schedules, deposit requirements, and cancellation policies outlined in your individual event contract or booking confirmation.

5. Intellectual Property

All content, branding, logos, software, text, graphics, and trademarks appearing on our website and applications are the exclusive property of The Birdie Bar or its licensors and are protected by applicable intellectual property laws. Unlawful copying or distribution is strictly prohibited.

6. Third-Party Links & Services

Our website and web applications may integrate with or link to third-party services (such as DocuSign, payment processors, or external reservation systems). We do not control and are not responsible for the availability, content, or privacy practices of third-party platforms.

7. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Birdie Bar, its owners, officers, employees, and agents shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of our website, web applications, or physical facilities.

  • Our total liability for any claim arising out of or related to these Terms or your use of the Services shall not exceed the amount paid by you to The Birdie Bar in the twelve (12) months preceding the event giving rise to liability.

8. Disclaimer of Warranties

Our website, web applications, and services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Colorado, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Colorado.
